企业专利组合协同效应研究

| 中文摘要 | 越来越多的企业都开始构建专利组合，采用专利组合的形式来构建技术壁垒，专利组合也在维持企业技术竞争优势方面发挥了重要作用。为什么专利组合会发挥如此大的作用？企业应该如何运用专利组合这一手段来实现利润增加？ 论文在综述前人研究成果的基础上，将协同学理论运用到企业专利组合，提出了专利组合协同效应内涵及专利组合协同效应形成机理，接着在案例研究的基础上运用专利组合协同效应形成机理，提出了企业专利组合协同效应的实际应用，包括专利组合协同效应前提条件、表现形式及专利组合优化方法，希望为企业专利战略及专利组合提供借鉴参考。 本文的第一部分是概述篇，主要是为提出本文即将研究的问题；第二部分是探讨篇，主要是依据协同学理论对专利组合的协同效应进行探讨；第三部分为深入篇，在理论分析的基础上提出专利组合协同效应的具体应用。最后以一个具体企业的专利组合为例，验证前文理论研究的可靠性。 首先概述篇，本文在阅览专利组合及协同效应相关文献的基础上总结了前人研究的特点，并发现目前很少有人在研究专利组合的协同效应。 在探讨篇中，本文在综述专利组合、协同效应的基础上，简单介绍了协同学理论基本内涵和主要概念；然后将协同学理论用于专利组合的分析，得出了专利组合协同效应的形成机理和专利组合的结构。 在深入篇中，根据前文的研究内容，结合案例分析，对专利组合形成协同效应的条件、表现形式进行了论述；最后提出企业优化专利组合的方法，为企业的专利战略乃至专利组合优化提供进一步的借鉴内容。 本文最后以山东泉林集团的专利组合为具体案例研究对象，通过对企业专利组合的技术构成年度分析，验证前文专利组合协同效应相关的理论。 研究表明，专利组合协同效应是指在企业专利组合中，各单件专利之间互相配合，使整个专利组合处于自组织状态，形成有序结构的整体效应和联合效应。企业可以从增加专利数量、减少专利数量、缩短协同所需弛豫时间和制定或调整专利战略这四个方面优化专利组合。 |
| 英文摘要 | Patent portfolios have been increasingly constructed by many enterprises to create technical barriers for competitors. Patent portfolios have brought competitive advantage for their owners. Why patent portfolios have been so important and how can they add value to their owners? How can companies optimize and improve their patent portfolios? On the basis of reviewing previous studies, the dissertation introduces synergy effect to patent portfolio, gives the concept of the synergy effect in patent portfolio, and elaborates the forming process of synergy effect in patent portfolio. Then, according to above content and on the basis of case studies, the dissertation analyzes the practical usage of synergy effect in patent portfolio, including the conditions of forming synergy effect in patent portfolio, the results of synergy effect in patent portfolio and the methods of optimizing patent portfolio to provide suggestions to corporate’ patent strategy and patent portfolios. Finally, this thesis analyzes a specific enterprise’s patent portfolio to manifact the theory. The first part of this dissertation is reviewing, introduces the questions that the dissertation is going to study. The second part is exploring, using the synergy theory and methods to analyze patent portfolio. The final part is application and case study, gives the practical usage of synergy effect in patent portfolio. First part: reviewing. According the previous papers and books about patent portfolio and synergy effect, the dissertation has found there are no previous studies about the synergy effect in patent portfolio. Second part: exploring. This dissertation introduces the synergy effect to patent portfolio and gives the concept of the synergy effect in patent portfolio, and elaborates the forming process of synergy effect in patent portfolio. Third part: practical application. The dissertation analyzes the practical usage of synergy effect in patent portfolio, including the conditions of forming synergy effect in patent portfolio, the results of synergy effect in patent portfolio and the methods of optimizing patent portfolio to provide suggestions to enterprises’ patent strategies and patent portfolios. Final part: case study. This dissertation takes a specific enterprise (Shandong Tralin Group) as an example and analyses the technical pattern of this company in each year to provide some practical foundation for the regarding theory above. Based on the content of the above parts, synergy effect in patent portfolio means the integral effect and combined effect which results from the supplement and collaboration between individual patents to make the whole patent portfolio being a self-organized structure. Companies can optimize their patent portfolios from four ways, which are adding more patents to its patent portfolio, decreasing the number of patents contained in patent portfolio, shorten the relaxation time when synergy effect in patent portfolio is formed and develop or change patent strategy. |
